Deliberate. Confidential. Accountable.

Valuation engagements go wrong in predictable ways. Scope is never defined, so cost is never predictable. The assignment gets confused with advocacy. Or the analysis arrives too late to shape strategy. Bayview runs engagements to avoid all three.

01

Intake and Scope

A conversation with counsel to identify the asset, the standard of value that applies, the effective date, and the purpose of the engagement. Purpose drives methodology, and the wrong purpose produces the wrong number no matter how careful the analysis.

02

Engagement Terms in Writing

Defined scope, defined deliverable, and a fee structure agreed before work begins. Fees are never contingent on the outcome or on the value reached.

03

Information Gathering

A specific document request tailored to the asset rather than a generic checklist, coordinated through counsel. Where records are incomplete, that limitation is identified early rather than discovered late.

04

Analysis

Methodology selected for the asset and the assignment, with the reasoning behind each judgment documented as it is made, not reconstructed afterward.

05

Deliverable and Support

A written report or a consulting summary, depending on the engagement, followed by whatever support counsel needs: rebuttal review, deposition preparation, settlement conference attendance, or testimony.

Consulting Engagement

Non-testifying work product for counsel's use in strategy, negotiation, and settlement evaluation. Often the right starting point, and frequently the only engagement a matter needs.

Valuation Report

A written analysis and conclusion suitable for production, negotiation, or filing.

Rebuttal and Critique

Review of an opposing expert's report to identify methodological weaknesses, unsupported assumptions, and inputs worth attacking on cross.

Independence

The conclusion is the conclusion. Counsel is told what the analysis supports, including when it does not support the client's position. A number that cannot survive scrutiny is worth nothing to anyone.

Scope Discipline

Fees are quoted against defined scope. If scope expands, that conversation happens before the work does.

Responsiveness

Litigation runs on deadlines. Engagements are accepted only when the calendar genuinely allows for them.
